Wausau Mayor Doug Diny's actions moving an outdoor ballot drop box have been referred to the Marathon County District Attorney and Wisconsin Elections Commission. The matter has been referred for investigation and video of Diny's removal of the ballot box is not being released,

The incident is the latest example in swing state Wisconsin of the fight over whether communities will allow voters to use absentee ballot drop boxes. The Wisconsin Supreme Court in July ruled that drop boxes are legal, but left it up to local communities to decide whether to use them.

City Clerk Kaitlyn Bernarde announced an official drop box was secured outside of Wausau City Hall after a box was previously removed from the spot before it was in use by Mayor Doug Diny. Bernarde previously said she reported Diny’s drop box removal to the Marathon County District Attorney and Wisconsin Elections Commission.

Wausau voters may now use the clerk’s office drop box to drop off absentee ballots after its return Monday following its removal by Mayor Doug Diny.
